1. About these terms
These terms set out how you may use the website at validay.co.uk (the "website"). The website is run by Validay Ltd ("Validay", "we", "us" or "our"), a company registered in England and Wales under company number 15262430.
By using the website, you agree to these terms. If you do not agree, please do not use the website.
2. Our consultancy services
Validay is a business-to-business consultancy. We provide independent go-live and delivery assurance and quality leadership to fire and rescue services, local government, higher education and other organisations facing critical change.
These terms cover use of the website only. Any consultancy services we provide are governed by a separate written proposal and agreement between Validay and the client. These terms do not form part of that agreement. Nothing on the website is an offer to provide services on particular terms.
3. Using the website
You may use the website for lawful purposes only. You must not:
-
use the website in a way that breaks any law or regulation, or that is fraudulent or harmful;
-
try to gain unauthorised access to the website, its server or any connected system;
-
introduce viruses, malware or other harmful material, or attack the website in any way;
-
use automated tools to scrape, copy or collect content from the website in bulk without our permission; or
-
send unsolicited marketing, spam or abusive, offensive or misleading content to us by email or through the website.
We may suspend or restrict access to the website, or any part of it, at any time and without notice. We do not guarantee that the website will always be available or free from errors.
4. Intellectual property
Unless stated otherwise, we own or are licensed to use all intellectual property rights in the website and its content, including text, blog posts, case studies, graphics and logos.
You may view, download and print content from the website for your own reference or internal business use, provided you do not change it and you acknowledge Validay as the source. You must not reproduce, republish or sell any content for commercial purposes without our written permission.
5. Accuracy of information and no advice
We aim to keep the website accurate and up to date, but we do not promise that the content is complete, accurate or current.
The content on the website, including blog posts and case studies, is for general information only. It is not professional advice and you should not rely on it as such. If you need advice for your own organisation or project, please contact us to discuss a written proposal.
6. Links to other websites
The website may contain links to websites run by other people or organisations. These links are provided for your information only. We have no control over those websites and are not responsible for their content, availability or privacy practices. A link does not mean we endorse the linked website.
7. Our liability
Nothing in these terms limits or excludes our liability for:
-
death or personal injury caused by our negligence;
-
fraud or fraudulent misrepresentation; or
-
any other liability that cannot be limited or excluded under the law of England and Wales.
Subject to that, and to the extent permitted by law:
-
we exclude all conditions, warranties and other terms that might otherwise apply to the website or its content; and
-
we are not liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from use of, or inability to use, the website, or from reliance on any of its content. This includes loss of profits, revenue, business, contracts, goodwill or data, and any indirect or consequential loss.
The website is intended for business users. If you use it as a consumer, nothing in these terms affects your statutory rights.
8. Privacy
If you contact us through the website, we will use your personal information as described in our Privacy Policy. Please read it to understand how we collect, use and protect your information. Information about the accessibility of the website is set out in our Accessibility Statement.
9. Changes to these terms
We may update these terms from time to time. The updated version will be posted on this page with a new "last updated" date. Please check this page whenever you use the website. Your continued use of the website after a change means you accept the updated terms.
10. Governing law
These terms, and any dispute or claim arising from them or from use of the website (including non-contractual disputes or claims), are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
